Terms at Within Hypnotherapy
Welcome to Within Hypnotherapy. These Terms and Conditions ("Terms") govern your use of the website within-hypnotherapy.com (the "Website") and any hypnotherapy services, sessions, consultations, or digital products (together, the "Services") provided by Within Hypnotherapy ("we", "us", "our").
By accessing the Website or booking any Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please do not use the Website or book any Service.
1. About Us
Within Hypnotherapy is a private practice based in Sandton, Johannesburg, South Africa, offering online hypnotherapy and related wellness services worldwide.

2. Nature of Services
Within Hypnotherapy provides complementary hypnotherapy services intended to support general wellbeing, emotional regulation, stress management, and personal development.
2.1 Important Medical Disclaimer
Hypnotherapy is complementary therapy. It is not a substitute for medical, psychiatric, or psychological diagnosis or treatment. Our Services do not constitute medical advice, counselling, psychotherapy, or psychiatric care.
You are strongly advised to:

Consult a qualified medical doctor, psychiatrist, or psychologist for any medical, mental health, or psychological condition.

Continue any prescribed medication or treatment unless advised otherwise by your treating medical professional.

Not use hypnotherapy as a substitute for emergency medical or psychiatric care.

2.2 Suitability
Hypnotherapy may not be suitable for everyone. You agree to disclose any medical or psychological conditions relevant to your suitability for hypnotherapy, including but not limited to:

Epilepsy or a history of seizures.

Psychosis, schizophrenia, or dissociative disorders.

Severe clinical depression or active suicidal ideation.

Severe personality disorders.

Any condition for which you are under specialist psychiatric care.
We reserve the right to decline, pause, or refer to a booking if we believe hypnotherapy is not appropriate for your circumstances.
3. Booking & Payment
3.1 Booking
Sessions are booked through the Website, by email, or by mutual arrangement. A booking is only confirmed once payment (or a deposit, where applicable) has been received and confirmation has been sent by email.
3.2 Fees
Current session fees are published on the Website or provided at the time of enquiry. We reserve the right to change fees at any time. Any change will affect sessions already booked and paid for.
3.3 Payment Methods
Payment is accepted in South African Rand (ZAR) unless otherwise agreed in writing. Accepted methods may include electronic funds transfer (EFT), card payment via a secure third-party processor, and other methods specified at the time of booking.
3.4 Medical Aid
Hypnotherapy is generally not covered by South African medical aids. Clients are responsible for their own payment. We are happy to provide a receipt upon request; however, we make no representation that any medical aid will reimburse fees.
4. Cancellations, Rescheduling & Refunds
4.1 Client Cancellations
We understand that life happens. Our cancellation policy is as follows:

More than 48 hours' notice: Full refund or free rescheduling.

Between 24 and 48 hours' notice: 50% of the session fee is refundable, or the session may be rescheduled at no charge.

Less than 24 hours' notice, or no-show: The full session fee is payable and no refund will be issued.
4.2 Practitioner Cancellations
If we need to cancel or reschedule a session, we will give as much notice as possible and offer you the choice of a full refund or a rescheduled session at no additional cost.
5. Online Sessions & Technology
Sessions are conducted online via a secure video platform.
You are responsible for:

A stable internet connection.

A private, quiet, and comfortable space free from interruptions.

Suitable headphones or audio equipment.

Ensuring you are not driving, operating machinery, or engaged in any activity requiring full attention during a session.
If a session is interrupted by technology failure on your side and cannot be resumed, the session may be rescheduled once at our discretion. If the failure is on our side, the session will be rescheduled at no additional cost.
6. Client Responsibilities
By booking a Service, you agree to:

Provide accurate and complete information about your health and circumstances.

Disclose any medication you are currently taking and any ongoing medical or psychological treatment.

Attend sessions sober and not under the influence of alcohol, recreational drugs, or any substance that may impair your participation.

Always treat the practitioner with respect and courtesy.
We reserve the right to end a session immediately, without refund, if a client is intoxicated, abusive, or otherwise behaves in a manner that is inappropriate or unsafe.
7. Confidentiality
Everything you share during a session is treated as strictly confidential. We will not disclose any information about you or our work together to any third party without your express written consent, except where:

Disclosure is required by South African law or a court order.

We have reasonable grounds to believe that you or another person is at risk of serious harm.

Disclosure is required in the context of clinical supervision (where any identifying information is removed).

8. Intellectual Property
All content on the Website, including text, images, graphics, logos, audio recordings, session materials, and downloadable resources, is the property of Within Hypnotherapy or its licensors and is protected by copyright and related intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, or create derivative works from any content without our prior written permission. Any audio recordings, guided meditations, or written materials provided as part of a Service are for your personal use only and may not be shared, resold, or publicly distributed.
You may not record, screenshot, or transcribe any part of a session without our express written consent.
9. Testimonials & Feedback
Any testimonial or review you choose to share may, with your consent, be used on the Website or in marketing materials. You may request removal of a testimonial at any time by contacting us, and we will remove it within a reasonable period.
10. Limitation of Liability
To the fullest extent permitted by South African law:

We make no guarantee, express or implied, regarding the outcome of any hypnotherapy session or Service. Results vary from person to person and depend on many factors outside our control.

We shall not be liable for any indirect, incidental, consequential, or special loss or damage arising from your use of the Website or Services, including but not limited to loss of profits, loss of data, or emotional distress.

Our total liability for any direct loss or damage arising from a Service shall not exceed the total amount paid by you for that specific Service.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded under South African consumer protection law.

We process personal information in accordance with the South African Protection of Personal Information Act, 2013 (POPIA) and, where applicable to clients in the United Kingdom or European Union, the UK GDPR / EU GDPR.
By using our Services, you consent to the collection, processing, and storage of your personal information as described in our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Website with a revised "Last updated" date. Continued use of the Website or Services after changes are posted constitutes acceptance of the revised Terms. For existing bookings, the Terms in force at the time of booking will apply.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms, the Website, or any Service shall be subject to the non-exclusive jurisdiction of the South African courts.
If you are a client based outside South Africa, by booking a Service you agree that South African law will apply, without prejudice to any mandatory consumer rights you may have in your country of residence.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
